NOT TO SPEC: End User License Agreement

Last updated: 30 October 2026

This agreement governs your use of the video game Not to Spec: A Dystopian Factory Inspection Game ("NOT TO SPEC" or "the game"), its updates and the content it includes. The game belongs to Pigeon Games S.L. (Spanish tax ID (NIF) B13714670, Calle Barca, Bl 3 Bj 2, 29011 Málaga, Spain; registered in the Málaga Commercial Registry, Volume 6333, Book 5241, Folio 209, Sheet 174186; email: info@pigeong.com), referred to here as "we" or "us".

1. You, us and your console

You buy or download the game from your console's store (PlayStation Store, Nintendo eShop or Microsoft Store). The purchase, payment, refunds, your account and the use of your console are governed by that platform's terms, which you also accept when you use its store.

This agreement applies in addition to the platform's terms. If any clause here conflicts with the platform's terms on matters concerning its store, its account or its console, the platform's terms prevail.

Sony Interactive Entertainment, Nintendo and Microsoft are not parties to this agreement. The obligations set out here are ours, not theirs.

2. What you may do

We grant you a personal, non-exclusive, non-transferable licence to install the game and play it on the consoles your account allows, under the platform's rules, for your private, non-commercial use.

You may record and stream your play sessions, upload videos and screenshots, and earn money from them on video and streaming platforms, as long as you do not suggest that we made or sponsor them. We may ask you to take a video down if it breaks the law or this agreement.

3. What you may not do

Except where the law allows you to regardless of this agreement, you may not:

None of this limits the rights that the law always gives a lawful user of a computer program, such as making a backup copy where it is necessary for use, or studying how the program works under the conditions of Article 100 of the Spanish Intellectual Property Act (Royal Legislative Decree 1/1996) and the equivalent rules in your country.

4. Who owns the game

The game, its code, art, music, text, name and logo belong to Pigeon Games S.L. or to third parties who have licensed them to us. Buying the game does not give you ownership of it, only the licence in clause 2. The trademarks of the consoles and of the engines and tools used belong to their owners.

5. How the game works

NOT TO SPEC is a single-player game. It has no online mode, no in-game purchases, no ads and no links to external sites. You do not need an internet connection to play, except where your console needs one to download or update the game or to check the licence. Saves are stored on the console. How we handle data is explained in the game's Privacy Notice.

We may release updates to fix bugs, improve the game or meet platform requirements. The platform delivers them to you, usually automatically.

6. Your rights as a consumer

If you are a consumer, you have the rights the law gives you, and this agreement does not reduce them. In particular, the game must match what was described when you bought it; if it does not, you have the rights set out in Article 114 onwards of the Spanish consolidated Consumer Protection Act (Royal Legislative Decree 1/2007) or the equivalent law in your country.

Withdrawal and refunds for the purchase are handled by your console's store, under its terms and the law. For downloaded digital content, the right of withdrawal may be lost once the download has started, if, when buying, you expressly consented to it starting and acknowledged that you would lose that right (Article 103(m) of the same Act).

7. Liability

We make the game with care, but we cannot promise it will never fail, or that it will work on consoles or system versions other than those it was released for.

We are not liable for damage caused by using the game in breach of this agreement, or for failures of the console, the store or the platform's network, which are under the platform's control.

Nothing in this clause limits or excludes our liability where the law does not allow it: for example, towards consumers, for wilful misconduct or gross negligence, or for death or personal injury.

8. End of the licence

You can stop using the licence at any time by uninstalling the game. If you seriously breach clause 2 or 3, we may end your licence, after warning you where possible. When the licence ends, you must stop using the game. Clauses 4, 6, 7 and 10 continue to apply.

9. Changes to this agreement

We may change this agreement if the law changes, a platform requires it or the game changes. We will publish the new version on this page with its date. Changes do not take away rights you already have over the game.

10. Governing law and courts

This agreement is governed by Spanish law. If you are a consumer, you keep the protection given by the mandatory rules of the country where you live, and you can bring a claim before the courts where you live. If you are not a consumer, the courts of Málaga have jurisdiction.

For any question or complaint, email info@pigeong.com. If you are a consumer in Spain, you can also go to the consumer arbitration boards (Juntas Arbitrales de Consumo) or the consumer services of your region.

This agreement is also available in Spanish.
